Terms of Service
These terms are a legal agreement between you and Testament Productions LLC, a California limited liability company (“we”, “us”), which operates Snorkel. By opening an invitation link, creating an account, or using Snorkel in any way, you agree to these terms. If you do not agree, do not use it.
1. What Snorkel is
Snorkel is a private, invite-only beta tool that lets you build a watchlist and view market prices and business metrics next to each other. It is an informational and educational tool only. It is a work in progress and may change, be interrupted, or be shut down at any time without notice.
2. Not investment, financial, tax, or legal advice
Nothing in Snorkel is investment, financial, tax, accounting, or legal advice, or a recommendation or solicitation to buy, sell, or hold any security. We are not a broker-dealer, investment adviser, or financial planner, and we do not know your circumstances. Prices, ratios, and other metrics are not forecasts. Investing involves risk, including loss of principal. Make your own decisions and consult a licensed professional before acting.
3. Data may be delayed, wrong, or missing
Prices, financial figures, and calculated metrics come from third-party sources and our own calculations. Prices may be delayed. Data may be inaccurate, incomplete, outdated, revised, or unavailable, and calculations may contain errors or rely on assumptions or definitions you do not share. Where a value cannot be provided, we try to say so, but we do not guarantee that we will. Do not rely on Snorkel for trading or any time-sensitive or high-stakes decision. All data and trademarks belong to their respective owners.
4. Eligibility and your account
- You must be at least 18 and able to form a binding contract.
- Access is by invitation only. An invitation link is a secret: keep it private, because anyone who opens it first can use it.
- You are responsible for everything that happens under your account and devices. Tell us promptly if you think your account was accessed without permission.
- We may decline, suspend, or end access to anyone at any time, for any reason.
5. Acceptable use
You agree not to: copy, scrape, harvest, republish, resell, or redistribute data or content from Snorkel; use automated tools to access it; interfere with or overload it; probe or test its security; try to access other people’s accounts or data; reverse engineer it except where the law allows; use it unlawfully; or share your access with others.
6. Your information
How we handle personal information is described in the Privacy Notice. You may delete your account from the Account page at any time. We may keep limited records and backups as described there. We may use anonymous, aggregated information to improve the service. You give us permission to store and process your watchlist settings to provide Snorkel.
7. Paid plans
Snorkel is currently free during the beta. If we introduce paid plans, we will tell you before you are charged, and the price, any free trial, renewal, cancellation, and refund terms will be shown to you at the time of purchase and will apply in addition to these terms.
8. Feedback
If you send us ideas or feedback, we may use them without obligation or payment to you.
9. Our rights
Snorkel, including its name, design, software, and content (other than your own information and third-party data), belongs to us or our licensors. We give you a limited, personal, revocable, non-transferable permission to use it for your own non-commercial purposes while these terms are in effect. All other rights are reserved.
10. No warranties
STOCK WATCH IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TIMELINESS, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY DATA OR METRIC IS CORRECT OR THAT YOUR DATA WILL NOT BE LOST.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, SAVINGS, INVESTMENT VALUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO STOCK WATCH OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE ABOVE, WE ARE NOT RESPONSIBLE FOR ANY INVESTMENT OR TRADING DECISION OR LOSS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO STOCK WATCH WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR STOCK WATCH IN THE TWELVE MONTHS BEFORE THE CLAIM AND (B) US $50. Some places do not allow certain limits, so parts of this section may not apply to you; in that case our liability is limited as far as the law allows.
12. Indemnity
You agree to defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of Snorkel, your breach of these terms, or your violation of any law or third-party right.
13. Ending your use
You may stop using Snorkel and delete your account at any time. We may suspend or terminate access or discontinue Snorkel at any time. Sections that by their nature should survive (including 2, 3, 5, 9, 10, 11, 12, and 14) will survive.
14. Disputes
Please contact us first and give us a chance to resolve any concern informally. To the extent the law allows, any claim must be brought within one year after it arises, and only on an individual basis, not as a plaintiff or class member in any class, collective, or representative action. These terms are governed by United States federal law and the laws of the State of California, without regard to conflict-of-law rules, and the state and federal courts located in California will have exclusive jurisdiction, unless the law requires otherwise.
15. General
If part of these terms is unenforceable, the rest remains in effect. These terms, with the Privacy Notice, are the whole agreement between you and us about Snorkel. You may not transfer your rights under them; we may. Our not enforcing a term is not a waiver of it. We may update these terms; if we do, we will post the new version here and change the date above, and continuing to use Snorkel after that means you accept the update. We may contact you by email at the address on your account.
